This Privacy Policy applies to information about you that Wild Orca, LLC (“Orca,” “we,” “our,” “us,” "the company") may obtain when you visit wildorca.co (the “Site”). This Privacy Policy describes how we may collect, use, or share information about you; your choices regarding our use of your information; how we safeguard such information; and how you may contact us regarding our privacy practices. 

 

Information We Collect

Personal Information You Provide

We may collect personal information (including name, address, telephone number, email address, and payment information) when you:

  • Place an order
  • Request more information
  • Create an account on the Site
  • Subscribe to email marketing
  • Enter a promotional contest or giveaway
  • Participate in a marketing survey, promotion or event
  • Submit a review
  • Request to be notified when an out-of-stock item is back in stock
  • Request a repair, return or exchange of one of our products

Information Collected Automatically

We use various tools and technologies like cookies, web beacons, and web server logs to collect information automatically on the Site. This information may include IP addresses, device identifiers, browser characteristics, operating system details, internet service provider details, language preferences, and details about your use of the Site (referring URLs, time and length of visits, and pages viewed). Our Site may be personalized based on various information we have about you to provide you with more location-relevant content.

Please note that we or third parties may collect personal information about your online activities over time and across different devices and online properties when you use the Site and we do not sell your data.

Information Collected By Other Parties

Our vendors may share with us your personal information that you submit to them. For example, if you apply for a credit card, pay for a purchase using PayPal, or return a purchase, you may submit personal information to one or more of our service providers that may share your information with us. We may combine information that we have about you with information we obtain from other parties to better serve you. When you submit information to another party, you are subject to that third party’s terms of use and privacy policies, for which we are not responsible.

We may engage vendors to provide certain interactive features on our Site. Your use of these interactive features is your choice and voluntary We may retain the information you submit through these features. We may offer an interactive chat feature on the Site to assist you with your order and for other customer service purposes. When you participate in the interactive chat, either with a virtual or live agent, the contents of the chat may be captured and kept as a transcript. By using these features, you understand that our vendors may process the information obtained through the feature to provide the service on our behalf.

 

Use of Personal Information

We may use your personal information to:

  • Contact you about the status of an order
  • Send you promotional offers we believe will be of interest to you
  • Send you Orca email correspondence
  • Identify your product and service preferences

  • Improve our merchandise selection and customer service
  • Administer a giveaway or similar promotion and identify or publicize the winner(s) in accordance with the rules for that promotion

 

Sharing of Personal Information

We may share your personal information with affiliates, business partners, vendors (e.g., payment processors, shippers, affiliate promoters, and website developers), and other parties in accordance with the service or interaction you perform on the Site.

In the event of a business transaction, such as if we sell or transfer all or a portion of our business or assets (e.g., further to a merger, reorganization, liquidation, or any other business transaction, including negotiations of such transactions), we reserve the right to disclose any information we obtain through the Site.

In addition, we may disclose your personal information if we are required to do so by law or we believe that such action is necessary to:

  • Comply with legal process such as a search warrant, subpoena or court order
  • Protect the company’s rights and property
  • Investigate reports of fraud or of users sending material using a false email address or users sending harassing, threatening, or abusive messages
  • Protect against misuse or unauthorized use of the Site

 

Analytics & Advertising

We, and our vendors, may use cookies, web beacons, and other similar technologies to collect or receive information about your internet usage, including your use of this Site, and use that information for interest-based advertising and to monitor and analyze trends on the Site. We and our vendors may use first-party cookies or other first-party identifiers as well as third-party cookies or other third-party identifiers to deliver relative advertisements, create a digital profile, measure interests, detect demographics, detect location, and personalize your content.

We may use third-party technology and vendors such as, Shopify, Meta, Google, TikTok, Spotify, and AfterPay, in connection with your activity on the Site to help us understand and analyze how visitors use the Site and to serve ads on our behalf across the Internet. For example, we’ve implemented certain advertising features such as remarketing with analytics, interest-based advertising, demographics and interests reporting, user segment analysis, and impression reporting. These technology companies and advertisers may use, store, or access cookies and other tracking technologies to collect or receive information from the Site, and elsewhere on the internet. 

You may be able to opt out of certain interest-based advertising using the settings on your browser or mobile device. In addition, the following services or organizations offer tools that you can use to limit or opt out of interest-based advertising:

  • To change your privacy and advertising settings with Spotify, login to your Spotify account and navigate to your account settings or disable app tracking on your smart device.

We do not control how third parties manage their opt-out processes. Please note that your opt-out choice(s) may apply only to the browser or device you are using when you opt out. If you opt out, you will still receive ads from Google, Meta, TikTok, and Spotify, but they may not be as relevant to you and your interests.

 

Social Features

The Site may permit you to interact with social media platforms operated by unaffiliated parties, for example, to “like” or "heart" Orca, it's content (posts) or to share content from the Site on those platforms (“Social Features”). If you choose to interact using Social Features, that information may be publicly displayed, and the party operating the other platform may receive certain information about you and your use of the Site. Additionally, if you interact with us through Social Features (e.g., if you “like” or “follow” our page on another platform), we may have access to information about you from that platform. Please note that if you mention or comment about Orca or our Site in your post on another platform, that platform may allow us to publish your post on our Site. In addition, we may receive information about you if a user on a social media platform gives us access to their profile and you are one of their followers or connections, or information about you is otherwise accessible through that other user. Please review the terms, policies, and settings of these other platforms to learn more about their data practices and/or adjust your settings.


Giveaways, Contests, and Similar Promotions

We may operate giveaways, contests, raffles, and similar promotions (each, a “Promotion”) jointly sponsored or offered by third parties that may require submitting personal information. If you choose to participate in a Promotion, your personal information may be disclosed to third parties as described in the terms applicable to that Promotion. Insofar as the terms applicable to a particular Promotion conflict with this Privacy Policy, the terms applicable to the Promotion shall control.


Your Choices

Communications Preferences

We offer choices about the types of information you receive from us. If you prefer not to receive emails or other communications from Orca or if you prefer to receive them less frequently, you may unsubscribe using the link provided in each email.

Accessing, Reviewing & Changing Your Personal Information

Registered users can review and change certain personal information (e.g., name, address, telephone number, email address, and payment information) at any time by creating an account and logging into your account on the Site or through the "Shop" app.

European Data

Although we don't currently sell in the EU and UK, we know that you may have stumbled upon us for our content and require a double opt in when subscribing to our email communication. Furthermore, we adhere to GDPR when collecting information per Shopify, Klaviyo, Mailchimp and other third parties we use for communication.

California Residents CCPA and CPRA

The California Consumer Privacy Act (CCPA) creates new consumer rights for residents of the state of California relating to the access to, deletion of, and sharing of personal information that is collected by businesses.

Do Not Sell

As a resident of California, you have the right to opt-out of the “sale” of your personal information to “third parties.” Sale is defined very broadly. The law defines “sale” more broadly than you might think. It doesn’t just include the exchange of data for money.

We do not transfer your information to third parties in exchange for money and we will not do so. However, we do transfer personal information to certain third parties in order to operate our business (for example, to market our products and services).

Right To Know

You may request that we provide you for the last 12 months a list of the categories of personal information we have collected about you, the categories of sources from which it was collected, the business purpose for collecting or “selling” the information, and the categories of “third parties” to whom we disclosed or “sold” that information. You may also request that we provide you in a machine-readable format a copy of the specific pieces of personal information we have collected about you in the past 12 months. You may make a request to know up to two times in a 12-month period, subject to limitations described in the law. Right To Delete

You may request that we delete any personal information that we have collected from you. However, the law exempts certain information from deletion. For example, we may keep information necessary for security and fraud detection. We also may keep information needed to provide you goods or services. When we respond to your request to delete, we will explain what (if any) information we have kept and why. Please note that the law does not consider anonymized or pseudonymized information to be “personal information,” and we may “delete” your information by anonymizing or pseudonymizing it.

Security

We take reasonable measures to protect your personal information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. Nevertheless, transmission via the Internet and online digital storage are not completely secure, so we cannot guarantee the security of your information collected through the Site. 


Information for Users Outside the United States

Please note that Orca is based in the USA and that personal information submitted to the Site will be transferred to a server in the USA and will be processed by staff operating in the USA. By submitting personal information through the Site to Orca, you consent to this transfer, processing and storage. Please be aware that the data protection laws and regulations that apply to your personal information transferred to the United States or other countries may be different from the laws in your country of residence.


Children's Privacy

Our Site is not intended for use by children under the age of 13, and we do not knowingly collect personal information from children under the age of 13. If we become aware that we have obtained personal information from a child under age 13 we will delete such information in accordance with applicable law.


Policy Changes

This Privacy Policy is subject to change at our discretion. We will indicate changes to the Privacy Policy by updating the “Effective date” at the beginning of the Privacy Policy. Your continued use of this Site after any update to this Privacy Policy will constitute your acceptance of the changes.
